Declarative Principle for the Right to Use Radiation Sources Introduced

The Government amended Appendix 2 to Resolution of the Cabinet of Ministers of Ukraine No. 314 “Some Issues of Economic Activities under Martial Law”. Now a declarative principle is introduced for obtaining the right to use radiation sources for the needs of hospitals.

Due to the consequences of russia’s full-scale invasion of the territory of Ukraine, including the destruction of medical infrastructure, numerous injuries to civilians and military, healthcare institutions need additional medical equipment. It is purchased both for public funds and for charitable assistance. That is why, in order to provide the necessary medical care for the military and civilians during the full-scale war, the Government amended the resolution.

Previously, the use of radiation sources was subject to mandatory licensing, whose stage lasted up to 2.5 months, putting of medical equipment into operation was delayed for a certain period, which did not allow using it, i.e. providing Ukrainians with medical care.

According to the declarative principle, an economic entity acquires the right to perform certain actions in terms of economic activities without obtaining a permit by notifying the administrator or relevant licensing authority about the compliance of its material and technical base with the requirements of law.

According to the Ministry of Health, the decision will allow quick mounting of equipment and prompt start using it for timely detection and effective treatment of various diseases.
